Celebrations Passport® Membership Program Terms and Conditions

We are currently not accepting new enrollments into the Celebrations Passport® Program; however, existing Members can continue to use and renew their membership.

Welcome to the Celebrations Passport ® Membership Program ("Passport Program"). By renewing your participation in the Passport Program (a "Membership"), you ("you," "your," or "Member") acknowledge and agree to be bound by all of the Terms and Conditions ("Terms") stated herein. If you do not agree to these Terms, do not enroll in the Passport Program. 1-800-Flowers.com, Inc. ("we," "us," "our," "Company," or "1-800-Flowers.com") reserves the right to modify or terminate the Passport Program at any time and in any manner, and participation in the Passport Program is subject to the and the of the 1-800-Flowers.com website (and its affiliate websites). PLEASE BE AWARE THAT THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT WAIVE YOUR RIGHT TO A COURT HEARING AND JURY TRIAL.

Eligibility

To be a Member in the Passport Program, you must be (1) a legal resident of one of the fifty (50) United States or the District of Columbia, (2) at least 18 years of age (or at least the age of majority in your state of residence), and (3) the record holder of a valid eligible payment method issued by a financial institution acceptable to 1-800-Flowers.com. Your payment method information will be maintained on file with 1-800-Flowers.com.

Personal Use

The Passport Program is for your individual personal consumer use only and may not be utilized by, or on behalf of, businesses, commercial enterprises, and/or third parties, including for the purpose of group purchases. The Passport Program may not be used by 1-800-Flowers.com Business Gifting Services customers or other corporate accounts, nor for the purpose of resale, profit, business or commercial purposes. You may not transfer or assign your Membership or the benefits of the Passport Program.

Using Your Membership Benefits

As a registered Member of the Passport Program, you must be signed into your account to utilize the online and mobile app membership benefits. Please note that if you utilize the Passport Program for orders placed via telephone, you will be required, at the time you place your order, to provide proof of Membership enrollment, as determined in the sole discretion of 1-800-Flowers.com. The Passport Program can neither be utilized nor accessed for orders placed with us at Company-owned or franchised retail stores.

Benefits, Restrictions & Exclusions

Your Membership applies to free standard shipping/no service charge on eligible products delivered weekdays to available locations pursuant to the terms below. Free standard shipping is generally limited to weekday-only delivery of your ordered products to your designated recipient at available locations, using the Standard or Ground shipping method. No service charge is generally limited to weekday-only delivery of your ordered products to your designated recipient at available locations and requires ordering at least two days in advance. If you use our toll-free telephone number to place your order, our call center representative can also provide you with details on product and delivery eligibility. Delivery locations for which the Passport Program may not be eligible vary by brand and product and may include, without limitation, deliveries to countries and territories outside the continental United States as well as deliveries to P.O. boxes.

As a Member of the Passport Program, you may elect to expedite the delivery of your order by paying an additional charge, including, but not limited to, a charge for (1) intra-day delivery time window, (2) same-day business day, (3) next-day business day, (4) two-day business day, or (5) weekend delivery (collectively, “Expedited Delivery”), if and when available. The additional charges for Expedited Delivery are shown for each product and tier of delivery on the 1800flowers.com website and affiliate websites. Expedited Delivery of your order may not be available depending upon several factors, including, but not limited to, the product selected, the geographic location of the intended recipient, the time of year (seasonal and holiday/non-holiday factors), and the available modes of delivery. 1-800-Flowers.com reserves the right, at any time, and without further notice, to change, modify or increase the charges for Expedited Delivery. In the event your order consists of multiple products, some of which are eligible for free shipping/no service charge, and others which are not, you will be required to pay for the shipping and/or services charges applicable for ineligible products for the method of delivery selected.

Certain products, services and promotions are excluded from, and may not be utilized in combination with, the Passport Program free shipping/no service charge benefit, including, but not limited to: (1) certain perishable and other products requiring expedited delivery, (2) certain products requiring delivery from specified or to remote origination points, including, but not limited to, orders being delivered to addresses outside the U.S., (3) products and services purchased on or through third-party websites, including, but not limited to, airlines, car rental, associations, and other membership organizations, (4) certain promotional, award, coupon, clearance and discount offers, including, but not limited to, those offered by third-party websites or marketing partners, and (5) products and services that are not offered on the 1-800-Flowers.com website and affiliate websites.

Gifts Containing Wine Items

Wine items gifts do not qualify for free standard shipping; however, Celebrations Passport® members enjoy a discounted flat-rate shipping fee of one cent ($0.01) on eligible wine items and gifts, where permitted by law. Shipping availability and restrictions vary by state, and all applicable fees will be displayed during checkout.

Automatic Renewal

Your paid Membership in the Passport Program is automatically renewed at the end of the one-year term from the date of your enrollment, and at the end of any subsequent automatic renewal term (“Auto-Renew”). Upon the one-year anniversary of your enrollment or any Auto-Renew of your Membership, you will be billed to `any eligible payment method on file (including the payment method used for your most recent purchase), for each successive period, at the then-current rate for the Passport Program applicable at the time of such renewal until you turn off the Auto-Renew feature for your membership.

Prior to any Auto-Renew, you will receive an email notification (at least 30 days but not more than 45 days in advance) with details about your upcoming renewal, current Membership fee, payment method, and how to manage your Membership.

Renewal Charge Attempts and Billing Authorization:

If your payment method fails, we may reattempt to charge the same payment method or charge another eligible payment method on file.
We participate in account-updater services (for Visa®, MasterCard®, AMEX®) that may automatically update card information to avoid interruption.
If all billing attempts fail, your Membership will not renew, and benefits will expire at the end of the term.

How to Turn Off Automatic Renewal

Should you decide that you do not want to renew your Membership, you can turn off the Auto-Renew feature in one of three (3) different ways: ONLINE

Early Renewal Option

From time to time, we may offer Members the ability to renew their Membership prior to the scheduled renewal date (“Early Renewal”). Early Renewal is optional and may include promotional pricing or offers. If you choose to renew early, your new term will extend your Membership and will begin immediately following the end of your current term, unless otherwise stated at the time of renewal. Your renewal date will update automatically to reflect the new term. This option is available within your online account screen, where you can view your renewal date and complete the Early Renewal process.

Refunds

The Membership fee is non-refundable.

Trial Memberships

We sometimes offer certain trial or similar promotional memberships (each, a “Trial Membership”) in the Passport Program for a limited period of time. To enroll in a Trial Membership, you may be required to provide a valid eligible payment method issued by a financial institution acceptable to 1-800-Flowers.com. In that event, your payment method information will be maintained on file with 1-800-Flowers.com. Depending on the promotion, you may not be charged for your Trial Membership for the promotional or trial period (“Trial Membership Period”). However, if the terms of the Trial Membership include Automatic Renewal we will automatically charge your payment method to continue you to a paid Membership at the end of the Trial Membership Period, unless you turn off the Auto-Renew feature prior to the end of the Trial Membership Period in accordance with one of the methods set forth above.

Member Information & Communications

Members may update or change their account information by accessing their Member profile at www.1800flowers.com or at many of our affiliate websites. Simply log into your account via the 1800flowers.com website (top right-hand corner of the homepage) or any of the Affiliated Websites, select the Celebrations Passport option, and then select Manage Account.

All Member notifications, transactional communications, confirmations and updates will be sent to you via the email address that you provided to us at the time of enrollment or thereafter. From time to time, 1-800-Flowers.com and the Affiliate Websites may wish to inform you of additional promotions and services that may, or may not, be associated with the Passport Program. By becoming a Member of the Passport Program, you expressly grant the Company your permission, and consent, to receiving emails and other communications from 1-800-Flowers.com and its affiliates at the email and postal addresses that you have provided to us. Should you wish to opt out of non-transactional communications you may receive from us or our brand affiliates, please refer to the instructions set forth in the 1-800-Flowers.com .

1-800-Flowers.com reserves the right, within our sole discretion, to refuse to accept and/or process any and all customer/Member orders, and/or to suspend, discontinue, and/or refuse the utilization of any of the Membership benefits of the Passport Program to anyone in the event of advertising or marketing errors, and/or in the event of actual or suspected misuse, fraud and/or abuse associated with use of the Passport Program. Furthermore, except as otherwise expressly allowed by the Company, the Passport Program may not be used or combined with other offers, promotions and/or discounts that may be offered from time-to-time by 1-800-Flowers.com or its brand affiliates, subject to applicable law.

1-800-Flowers.com reserves the right, at any time, and without notice, to change, modify or discontinue the Passport Program (including, but not limited to, Membership fees, benefits and surcharges); however, any applicable changes to your Membership fees will only apply upon renewal of your Membership. Moreover, 1-800-Flowers.com reserves the right to make any changes, modifications and/or additions to, or deletions from, these Terms and Conditions of the Passport Program (“Modifications”), and the 1-800-Flowers.com  and , with or without notice, subject to applicable law. Your continued use of the Passport Program following any such Modifications constitutes your acceptance and agreement of same.

Dispute Resolution: Arbitration, Waiver of Jury Trial, and Class Action Waiver

You agree that any and all claims, disputes, controversies, actions or proceedings relating to, or arising out of, the creation, production, manufacture, distribution, promotion, marketing, advertising (including oral and written statements), use of, exploitation, or sale of the Passport Program, through all channels (collectively referred to as "Claims"), shall be governed by the internal substantive laws of the State of New York without regard to its conflict of laws principles and that any and all Claims shall be resolved exclusively by final and binding arbitration or by a state small claims court with jurisdiction over the Claim and the parties. Any Claim you may have must be commenced within one (1) year after such Claim arises.

You agree that any arbitration shall be conducted as set forth in the 1-800-Flowers.com . THERE SHALL BE NO RIGHT TO LITIGATE YOUR CLAIM IN COURT AND NO RIGHT TO A JURY TRIAL. YOU SHALL NOT HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION.
